AutoVision – Der Personaldienstleister GmbH & Co. OHG authorises the use of this website only on the basis of these Terms of Use and the latest version of the privacy policy. If the male form of “User” is used in these Terms of Use, it equally refers to male and female users.

1.   General Provisions

1.1 These websites may only be used for lawful purposes.

1.2 The User may not enter incomplete, inaccurate, or misleading information. Actions that harm system or network security or have the intention to do so (e.g. obtaining unauthorised access or implanting a virus) are prohibited and will be civilly and criminally prosecuted.

2. Service description for job portal  

2.1 AutoVision – Der Personaldienstleister GmbH & Co. OHG offers a job portal on its website for job-seeking users. Users may use the websites to retrieve job openings and additional information and to apply for the advertised job openings based on these Terms of Use.

2.2 The User is expressly advised that he may apply to a job posted on the website only by submitting an online application via the job portal. AutoVision – Der Personaldienstleister GmbH & Co. OHG reserves the right to ignore or return applications that are submitted via other means (e.g. in writing or via e-mail). Due to privacy reasons, data media are fully deleted or destroyed after the User is notified.

2.3 If the User applies for a job via the job portal for the first time, he or she will receive an e-mail confirmation of receipt of the application immediately after completing the application process. In addition, this e-mail includes login details, consisting of a username and password for the personal login area. Login details are automatically generated. The login area includes the personal data and documents (applicant profile) that the User has entered for the application. The User can independently manage and update their applicant profile and submit additional applications to AutoVision – Der Personaldienstleister GmbH & Co. OHG under their applicant profile. Furthermore, the User can change their personal access information in the login area. The User should immediately replace the temporary password with a new password.
An applicant profile can be created only in conjunction with an application.

2.4 The User is obliged to keep confidential the password that enables access to the applicant profile. Under civil and criminal law, the User is responsible for any authorised or unauthorised use of this access data and undertakes to report any unauthorised use of AutoVision – Der Personaldienstleister GmbH & Co. OHG and to immediately change the password in such a case. AutoVision – Der Personaldienstleister GmbH & Co. OHG reserves the right to take the necessary measures if AutoVision – Der Personaldienstleister GmbH & Co. OHG learns of possible password abuse.

AutoVision – Der Personaldienstleister GmbH & Co. OHG has in case of

1. suspected or discernible abuse of the websites

2. damage or impairment to website functionality and

3. other severe infringements against these Terms of Use

4. the right to remove the user’s content from the applicant profile.

The User must be immediately notified of the removal of the content along with the reasons for doing so, and the User must be requested to demonstrate and, if necessary, substantiate the legality. If the User fails to comply with this request within a reasonable time frame, AutoVision – Der Personaldienstleister GmbH & Co. OHG shall have the right to delete the data or the provided content and to terminate the User’s registration and access authorisation.

3.5 The User agrees that all essential messages regarding the user relationship of the job portal at the website of AutoVision – Der Personaldienstleister GmbH & Co. OHG shall be sent by e-mail, unless required in another format.

3. Liability

3.1 AutoVision – Der Personaldienstleister GmbH & Co. OHG shall be liable—for whatever legal reason—only if damages

1. have been caused due to culpable breach of an essential obligation (cardinal obligation) in a manner that jeopardises the achievement of the contractual purpose or

2. is due to gross negligence or intent.

3.2 Should AutoVision – Der Personaldienstleister GmbH & Co. OHG be liable for the breach of an essential contractual obligation pursuant to Clause 6.1 lit. (a) without any occurrence of gross negligence or intent, the liability shall be limited to the extent of damage which AutoVision – Der Personaldienstleister GmbH & Co. OHG must typically expect upon conclusion of the contract due to the circumstances known to them at the time.

3.3 AutoVision – Der Personaldienstleister GmbH & Co. OHG shall particularly assume no responsibility for the following:

1. The success or failure of online applications;

2. That the website and its server are free from computer viruses or other harmful mechanisms;

3. The accuracy, completeness, and topicality of the content of this website and responsibility for other websites that are linked via one or several hyperlinks and which are operated by third parties. AutoVision – Der Personaldienstleister GmbH & Co. OHG does not assume ownership of the content of these websites.

3.4 The User shall be liable for any detriments that AutoVision – Der Personaldienstleister GmbH & Co. OHG suffers due to abusive or illegal use of the website or due to the User’s culpable failure to comply with his obligations as per these Terms of Use or the privacy policy. The User alone shall be responsible for the content of the applicant profile.

3.5 If a third party files a claim against AutoVision – Der Personaldienstleister GmbH & Co. OHG due to a breach of obligation for which the User is culpable, the User shall exempt AutoVision – Der Personaldienstleister GmbH & Co. OHG from any claims or pay compensation to AutoVision – Der Personaldienstleister GmbH & Co. OHG.

4. Applicable law

The legal relationships between the User and AutoVision – Der Personaldienstleister GmbH & Co. OHG arising from or associated with the usage of the website by the User shall be governed solely by the laws of the Federal Republic of Germany, unless prohibited by mandatory statutory provisions of foreign law.
